链家衍生金融产品成消费者“噩梦”-搜狐财经   ■案例纠纷点:首先,买家签署的《居间合同》中,房产中介故意隐瞒了资产抵押这一重要信息。其次,环环相扣的交易过程中,房产中介自己“研发”的衍生金融产品犹如一块“绊脚石”,牵制着房屋交易。   ■本报记者 徐晶卉   由于房产市场的多样化、房产权属关系的复杂性以及交易金额巨大,房产中介一直是绝大多数消费者在二手房交易时的首选。然而,若是商家有心设下“暗桩”,不知情的消费者很容易“深陷其中”。   继市消保委前天公开炮轰沪上房产中介“新贵”链家设层层“暗桩”,致使消费者权益受到严重侵犯后,昨天,市住建委等监管部门快速跟进,对被曝光的两个案例正式展开调查,涉事门店及相关经纪人员的网上签约资格即日起被暂停。市住建委同时表示,对于消保委提供的近20个链家投诉将“一个个查过去”。   在这些复杂的案件背后,衍生金融服务的身影浮出水面―――在居间合同中故意隐瞒重要信息,然后利用衍生金融服务阻碍买卖双方正常交易,继而通过各种“解决方案”赚钱,成为了链家获取利益的重要方式。   消费者哭诉“暗桩”环环相扣   今年1月9日,消费者庄先生为儿子购买婚房,在链家签订了一份《房屋买卖居间合同》,协商价格为370万元,首付80万元,并约定9天后签定《买卖合同》。1月15日,“暗桩”出现―――链家突然告知,这套房源除了银行贷款之外,还有一笔167万元的房屋抵押贷款,必须解除抵押才能签订买房合同。庄先生提出解除合同,但是遭到链家拒绝,称一旦违约,80万元定金需要在房屋另行交易后才能收回。   庄先生只是碰到了“暗桩”的前半段故事,有着相同遭遇的黄先生则哭诉了他碰到的一连串“暗桩”后续。去年8月,黄先生在链家签订了《居间合同》,支付定金后,被链家告知该房屋名下还有一笔340万元的银行抵押贷款,链家表示,首付七成280万元可以弥补抵押,为防止风险。黄先生提出资金监管,但链家称没有义务,黄先生三思之下,在签订《买卖合同》时明文规定280万   必须用于先偿还银行和个人抵押。   然而事实是,房屋抵押去年3月已经逾期,房屋已处在被查封的过程中,但黄先生拿不出这么多钱来解除查封。“当时链家说,他们会负责到底,他们借钱给我,把这个房产继续交易下去。”无奈的黄先生与链家贷款部人员签订了三方协议,由链家高息垫资110万元。   本以为可以过户了,没想到,11月2日、11月10日、12月10日,该房产分别被浦东新区、虹口区法院和市二中院分别查封,此时链家又做起了甩手掌柜,说“签后查封的房子不归我们管”。而等到黄先生自己解决了问题后,链家的“暗桩”又出现了,他们以不承担风险为由,逼着黄先生的父母为110万元垫资款做房屋信用担保,才答应过户。   衍生金融产品上下家“通吃”   仔细剖析这两起纠纷,不难发现有两个共同点。首先,买家签署的《居间合同》中,房产中介都故意隐瞒了资产抵   押这一重要信息。其次,环环相扣的交易过程中,房产中介自己“研发”的衍生金融产品犹如一块“绊脚石”,牵制着房屋交易。   事实上,庄先生后来发现,卖家那份167万元的房屋抵押贷款,放款方竟然就是链家―――链家自己设计金融产品,以公司员工的名义出借钱款,并赚取利息。而在黄先生的案例中,同样也出现了110万元的房屋抵押贷款,出借方也是链家。记者在庄先生提供的《房地产抵押借款合同》上看到,这份贷款的月利率为1.6%,换算成年利率高达19.2%,超过了央行规定的同期基准利率4倍的规定。   上海市沪中律师事务所高级律师董敏华认为,链家自己设计产品,在上一套房源嵌入房产抵押产品,然后卖给不知情的下家,“我相当怀疑链家在设局。”   有业内人士称,链家的衍生金融产品才是最大“暗桩”,不仅能获取不菲利   率,而且能形成一个循环,上下家“通吃”,“如果下家付了定金,却无法支付房屋抵押贷款,就会向黄先生一样,被迫将另外一套房源作房产抵押,而这套房源日后进入交易市场,相当于又为下一买家埋了一个‘雷,。”   衍生金融产品监管在何方   目前,链家虽对上述两个案例给出了解决方案,但对衍生金融产品的资质问题只字未提。而链家法务部相关人员在回应时含糊表示,并不清楚公司有没有相关金融服务的许可备案。董敏华认为,且不论链家有没有这个金融资质,“员工出钱,公司设立金融产品”的做法显然就不合规。   记者注意到,房产中介推出类似的金融衍生产品并非链家一家,而且也并非今年才有的新事物,然而却始终没有被纳入监管。市住建委相关负责人回应表示,这是房产中介服务的新业务,目前正在与市金融办方面做协调,调研和梳理相关问题。   据最新消息,市住建委昨天上午已约谈链家公司相关负责人,初步发现了链家公司相关门店存在不规范的经营行为,并开展正式调查。市住建委表示,将进一步加大对房地产经纪市场的监管力度,及时查处违法违规行为,切实维护交易当事人合法权益。相关的主题文章:
